Overview
Welcome to MyGemly ("we," "us," or "our Store"). MyGemly is an online store specializing in personalized custom bracelets. Through our website and services, you may select beads, charms, and styling options from our materials list, provide your wrist size, and we will individually craft a one-of-a-kind bracelet based on your personalized selections.
These Terms of Service ("Terms") govern your access to and use of our website, services, and all products purchased through our services. Please read these Terms carefully before using our services.
By accessing, interacting with, or using our services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or the Privacy Policy, you must not use or access our services.
Section 1 — Access and Account
1.1 By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country or region of residence, and you consent to us allowing any minor dependents in your household to use our services on a device owned, purchased, or managed by you.
1.2 To use our services, including accessing or browsing our online store, creating designs, or purchasing any products, you may be required to provide certain information, such as your email address, billing information, payment information, and shipping information. You represent and warrant that all information you provide in our store is true, complete, and current, and that you possess all necessary rights to provide such information.
1.3 You are solely responsible for maintaining the security of your account credentials and for all activities that occur under your account. You may not transfer, sell, assign, or permit any other person to use your account.
Section 2 — Custom Products
2.1 Custom Nature. All bracelets sold on our Store are custom-made goods. Each product is individually crafted to your personal specifications: you select beads, charms, and styling combinations from our materials list, provide your wrist length and preferences, and we make the bracelet individually for you based on these personalized choices.
2.2 Special Notice for EU Consumers and Our Enhanced Policy. Under Article 16(c) of the EU Consumer Rights Directive (2011/83/EU), custom-made goods are exempt from the 14-day cooling-off period (right of withdrawal). Notwithstanding this, we voluntarily offer you more favorable, tiered cancellation and modification options than required by law, as detailed in Section 3 of these Terms. This Section does not affect your statutory rights if a product suffers from a quality defect or materially deviates from the confirmed effect.
2.3 Product Presentation. We have made every effort to accurately display our products in our online store. However, due to differences in device types, screen settings, and configurations you use to access the store, the actual color, texture, and appearance of a product may reasonably differ from what you see on your screen. Natural materials (such as gemstones, wood, etc.) have unique colors, textures, and patterns; natural variations in each product are normal and do not constitute a quality defect.
2.4 Custom Result Confirmation. You understand and agree that the design rendering you create through our simulator is a schematic representation. The final physical product will be crafted according to your custom selections, and we will provide you with photographs of the finished product for your review before shipment. Reasonable variations from the rendering (such as shade variations in natural materials, grain direction, etc.) do not constitute non-conformity of the product.
2.5 We reserve the right to discontinue any product or material at any time and may, on a case-by-case basis, limit the quantities of any product we offer to any person, geographic region, or jurisdiction.
Section 3 — Orders, Cancellations, and Modifications
3.1 Order Placement and Production. Upon acceptance of your order (evidenced by the order confirmation email), we will immediately commence sourcing materials and arranging production. Concurrently, you enjoy the tiered cancellation and modification rights set forth below.
3.2 Tiered Cancellation Rules.

(a) After payment, before production begins: You may cancel your order for a full refund.

(b) Production started, before effect confirmation: You may cancel your order. We will deduct the materials and labor costs actually incurred (typically 30%-50% of the order amount) and provide you with a cost breakdown. The remaining balance will be refunded.

(c) Effect confirmed, before shipment: You may cancel your order. We will charge a fee equal to 50% of the order amount to cover design and production costs, and the remaining balance will be refunded.

(d) Shipped (after carrier pickup): The order cannot be canceled. Please refer to Section 6 (Shipping, Refusal, and Risk) for further handling.
3.3 Tiered Modification Rules.

(a) Before production begins: You may freely modify your custom design at no additional cost.

(b) Production started, before effect confirmation: You may request modifications, but we will need to reschedule production, and the shipping time will be delayed accordingly.

(c) Effect confirmed, before shipment: Modifications are generally difficult but please contact customer service, and we will do our best to accommodate. If a modification is not feasible, you may cancel the order under Section 3.2(c).
3.4 Custom Confirmation Process. After your custom bracelet is crafted, we will send you an effect confirmation notice via email with photographs of the finished product for your review. You must respond within 48 hours to confirm or raise any modification requests.
Important Notice: If you fail to respond within 48 hours, we will send one reminder after 24 hours. If you still fail to respond within a total of 72 hours from the first notice, you will be deemed to have no objection to the custom result, and we will arrange shipment. Your silence in this instance will be treated as confirmation of the custom result, and the order will enter the "Effect Confirmed, Before Shipment" phase, where cancellation is restricted. Please monitor your notifications carefully.
3.5 Merchant Cancellation Right. MyGemly reserves the right to cancel an order for reasonable cause such as material shortage or pricing errors. If we cancel your order, you will receive a full refund with no charges.
3.6 You represent and warrant that you are purchasing products for personal or household use and not for any commercial resale or export purpose.
Section 4 — Pricing and Billing
4.1 Prices, discounts, and promotional offers are subject to change without notice. The price charged for a product or service is the price in effect at the time you place your order, as listed in your order confirmation email. Unless otherwise expressly stated, published prices do not include taxes, shipping fees, handling fees, customs duties, or import charges.
4.2 You agree to provide complete and accurate purchase, payment, and account information for all purchases made in our store. You agree to promptly update your account information, including your email address, credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed.
4.3 You represent and warrant that: (i) the payment information you provide is true, correct, and complete; (ii) you are authorized to use that payment method for the purchase; (iii) charges incurred by you will be honored by your payment institution; and (iv) you will pay all fees at the published prices, including shipping fees, handling fees, and all applicable taxes.
Section 5 — Shipping and Delivery
5.1 Production and Delivery Time. Your custom bracelet will enter the final shipping preparation stage after you confirm the effect (or are deemed to have confirmed it under Section 3.4). The estimated production time is 3 to 5 business days, and estimated transit time varies by destination, typically 7 to 12 business days after the product is handed to the carrier. All shipping times are estimates only and we do not guarantee them.
5.2 Split Shipments. If your order contains multiple items, we may ship each item as it is completed. You will receive multiple tracking numbers. Any additional shipping costs incurred due to split shipments will be borne by us.
5.3 Customs Duties and Import Fees. You are solely responsible for any customs duties, value-added tax, import taxes, and other customs-related fees that may be imposed when the product is imported into your country or region.
Section 6 — Shipping, Refusal of Delivery, and Risk
6.1 Risk of Loss. The risk of loss or damage to the product passes to you upon your or your designated recipient’s acceptance of delivery. Notwithstanding the foregoing, in the event of loss or damage during transit, we will provide you with advance compensation as set forth in Section 6.3.
6.2 Title. Title to the product passes to you upon full payment, at the time the product is handed to the carrier, but this does not affect the risk of loss provisions above.
6.3 Handling of Shipping Issues.

(a) Stalled Tracking: If tracking information has not updated for more than 15 business days after shipment, please contact us. We will initiate an inquiry with the carrier and follow up.

(b) Delivered but Not Received: Please first check around your doorstep, with property management, neighbors, or parcel pickup points. If you confirm it is lost, contact us. Upon verification, we will immediately reship or issue a full refund, without waiting for the outcome of our claim against the carrier.

(c) Damaged upon Receipt: If you notice severe crushing or damage to the outer packaging upon delivery, please open and inspect it on the spot. If the item is damaged, please refuse delivery or take photos immediately. We require at least 4 photos of the outer packaging, inner packaging, the damaged item as a whole, and a close-up of the damage. Contact customer service and send the photos within 48 hours of delivery. Upon verification, we will immediately reship or issue a full refund.
6.4 Refusal of Delivery.

If you refuse delivery simply because you have changed your mind, you will be responsible for the return shipping costs and any losses arising during the return transit.

If the refusal is due to our error (e.g., we shipped the wrong item, the product is defective, or it materially differs from the finished product photographs you confirmed), you are fully entitled to refuse delivery. We will bear all round-trip shipping costs and will provide a full refund or remake upon receipt of the returned item.
6.5 Incorrect Address. Please ensure your shipping address is accurate. If you need to modify the address before shipment, please contact us immediately; we will do our best to intercept the package but cannot guarantee success. If a package is returned or lost due to an incorrect address, unreachable phone number, or unclaimed delivery, you will be responsible for the reshipment costs, and we cannot be held liable for lost packages in such instances.
Section 7 — Intellectual Property
7.1 Our Intellectual Property. Our services, including but not limited to all trademarks, branding, text, displays, images, graphics, videos, audio, and related designs, selections, and arrangements, are owned by MyGemly, its affiliates, or licensors and are protected by copyright, trademark, and other intellectual property laws.
7.2 User Designs. The intellectual property rights to the bracelet designs you create using our simulator tool (including bead selections, arrangements, and styling combinations) belong to you. You grant MyGemly a non-exclusive, royalty-free, worldwide, sublicensable license to display, promote, advertise, and improve our services, including but not limited to using your designs on our website, social media, advertising, and case studies.
7.3 Usage Restrictions. These Terms permit you to use the services for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any material on our services without our prior written consent.
7.4 Trademarks. The name, logo, product and service names, designs, and slogans of MyGemly are trademarks of MyGemly, its affiliates, or licensors. You must not use such trademarks without the prior written permission of MyGemly. All other names, logos, product and service names, designs, and slogans on the service are the trademarks of their respective owners.
Section 8 — User Design Sharing
8.1 Sharing Feature. Our services allow you to share your bracelet designs via a link or a poster. The shared content may include MyGemly’s branding, website information, and a QR code directing to our services.
8.2 Use of Shared Content. When you share your design, you authorize MyGemly to display your design in the shared content and allow other users to view your design through the sharing link. Other users may load your design information in the simulator through your sharing link and may place an order based on your design.
8.3 Sharer’s Responsibility. You are solely responsible for the design content you share. You must not share any design that infringes third-party intellectual property rights or contains defamatory, obscene, illegal, or malicious content. MyGemly reserves the right to remove any shared content that violates these Terms without prior notice.
8.4 Orders Placed by Third Parties via Sharing Link. When a third party places an order through your sharing link, a direct sales contract is formed between that third party and MyGemly. You, as the sharer, are not a party to that transaction and assume no liability for it.
Section 9 — Third-Party Tools and Links
9.1 Our services may provide you with access to third-party tools or links to third-party websites over which we do not monitor, control, or have any input.
9.2 You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations, or conditions of any kind. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools or your access to third-party websites.
9.3 Your use of any optional tools or third-party websites offered through the service is entirely at your own risk. You should ensure that you are familiar with and agree to the terms of service and privacy policies of the relevant third-party providers.
9.4 We are not liable for any harm or damages related to your access to any third-party website or your purchase or use of any products, services, resources, or content on any third-party website.
Section 10 — Relationship with Shopify
MyGemly is powered by Shopify. However, any sales and purchase transactions you conduct in our Store are completed directly with MyGemly. By using our services, you acknowledge and agree that Shopify is not responsible for any transactions between you and MyGemly, including any injury, damage, or loss caused by the products and services purchased. You hereby release Shopify and its affiliates from all claims, damages, and liabilities arising out of or in connection with your purchase transactions with MyGemly.
Section 11 — Privacy Policy
11.1 All personal information we collect through our services is governed by our Privacy Policy. As the services are hosted by Shopify, Shopify will collect and process personal information about your access to and use of the services in order to provide and improve the services to you. Information you submit to the services will be transferred to and shared with Shopify and potentially other third parties located outside your country. Please review our Privacy Policy for details on how we, Shopify, and our partners use your personal information.
11.2 Special Notice for EU Users. If you are an EU resident, your personal information will be processed in accordance with the General Data Protection Regulation (GDPR). Please refer to our Privacy Policy for specific details on data processing, including the legal basis for transferring data to third countries.
Section 12 — User Feedback
12.1 If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, comments, or other content (collectively, "Feedback"), you grant us a worldwide, perpetual, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback for any purpose in any media.
12.2 You represent and warrant that: (i) you have or possess all necessary rights to submit all Feedback; (ii) your Feedback will comply with these Terms. We have no obligation to (1) keep your Feedback confidential; (2) pay compensation for your Feedback; or (3) respond to your Feedback.
12.3 Your Feedback must not infringe any rights of any third party, including copyright, trademark, privacy, personality, or other proprietary rights. Your Feedback must not contain defamatory, illegal, abusive, or obscene content, or any computer viruses or other malware that could affect the operation of the service.
Section 13 — Errors, Inaccuracies, and Omissions
Occasionally, there may be information on our service that contains typographical errors, inaccuracies, or omissions regarding product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).
Section 14 — Prohibited Uses
14.1 You may only access and use the service for lawful purposes. You must not access or use the service: (a) for any illegal or malicious purpose; (b) to violate any international, federal, national, or local laws or regulations; (c) to infringe upon or harm our intellectual property or that of others; (d) to harass, abuse, insult, harm, defame, slander, intimidate, or injure any of our employees or any other person; (e) to transmit false or misleading information; (f) to send any advertising or promotional material, including any "junk mail," "chain letters," or similar solicitation; (g) to impersonate or attempt to impersonate any other person or entity; or (h) to engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the service.
14.2 Furthermore, you agree not to: (a) upload or transmit any viruses or malicious code; (b) reproduce, duplicate, copy, sell, or exploit any portion of the service; (c) collect or track the personal information of others; (d) spam, phish, crawl, scrape, or spider; or (e) interfere with or circumvent the security features of the service.
Section 15 — Termination
15.1 We may terminate this agreement or your access to the service at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
15.2 The following provisions will survive termination: Intellectual Property, User Designs, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.
Section 16 — Disclaimer of Warranties
16.1 The information provided on or through the service is for general informational purposes only. We make no warranties as to the accuracy, completeness, or usefulness of this information.
16.2 Except as expressly stated by MyGemly, the service and all products delivered through the service are provided "as is" and "as available" without any express or implied warranties or conditions, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that your use of the service will be uninterrupted, timely, secure, or error-free. Some jurisdictions restrict or do not allow disclaimers of implied warranties, so the above disclaimers may not apply to you.
Section 17 — Limitation of Liability
To the fullest extent permitted by law, in no event shall MyGemly, our partners, directors, officers, employees, affiliates, agents, contractors, service providers, or licensors be liable for any direct, indirect, incidental, punitive, special, or consequential damages, including without limitation lost profits, lost revenue, lost data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any service or product, even if advised of the possibility of such damages. Some jurisdictions do not allow the limitation or exclusion of incidental or consequential damages, so the above limitation may not apply to you.
Section 18 — Indemnification
You agree to indemnify, defend, and hold harmless MyGemly, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any third-party claims, damages, liabilities, or losses, including reasonable attorneys’ fees, arising out of: (1) your breach of these Terms of Service; (2) your violation of any law or the rights of a third party; or (3) your access to and use of the service.
Section 19 — Severability
If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.
Section 20 — Waiver; Entire Agreement
20.1 Our failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
20.2 These Terms of Service and any policies or operating rules posted by us on this site or in respect to the service constitute the entire agreement between you and us, govern your use of the service, and supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us.
Section 21 — Assignment
You may not assign this agreement or any of your rights or obligations under these Terms without our prior written consent. We may assign, transfer, or delegate these Terms and our rights and obligations without your consent.
Section 22 — Governing Law and Dispute Resolution
22.1 Governing Law. These Terms of Service shall be governed by and construed in accordance with the laws of the People’s Republic of China, without regard to conflict of law principles, provided that these Terms shall not affect any mandatory rights you enjoy under the laws of your country of habitual residence as a consumer.
22.2 Negotiation. Any dispute arising out of or relating to these Terms or your use of the service shall first be attempted to be resolved through friendly negotiation. Please contact us at support@mygemly.com.
22.3 Consumer Choice of Forum. If you are a consumer in the EU, UK, US, or another jurisdiction, you may either bring proceedings in the courts of your domicile or choose to submit the dispute to the arbitral institution specified in Section 22.4 below. This means you have the right to choose.
22.4 Arbitration (Applicable When Consumer Chooses Arbitration or for Non-Consumer Disputes). If a dispute cannot be resolved through negotiation and the consumer’s right of court jurisdiction under Section 22.3 is not invoked, either party may submit the dispute to the Hong Kong International Arbitration Centre (HKIAC) for arbitration in accordance with the HKIAC Arbitration Rules in effect at the time of applying for arbitration. The seat of arbitration shall be Hong Kong. The language of the arbitration shall be Chinese or English. The arbitral tribunal may conduct the proceedings by remote video conferencing as it deems appropriate. The arbitral award shall be final and binding upon both parties.
22.5 Emergency Relief. Notwithstanding the foregoing, MyGemly may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

The headings used in this agreement are for convenience of reference only and shall not affect the interpretation of these Terms.

24.1 You can review the most current version of the Terms of Service at any time on this page.
24.2 We reserve the right to update, change, or replace any part of these Terms of Service by posting updates on our website. It is your responsibility to check our website periodically for changes.
24.3 For material changes to these Terms, we will provide you with advance notice via email or by posting a prominent notice on our website. Changes will take effect on the date specified in the notice. Your continued use of or access to the service following the posting of any changes constitutes acceptance of those changes.
